
Sellers Responsibilities (YOU)
- Each cell phone must be fully functional. That means it must power on, LCD displays work and not broken or bleeding, keypad works, scroll bars works, no broken antenna, no water damage, no loose or broken flip, display light comes on, and not have a cracked body. A red dot that has "bled" beneath your battery on your phone is an indication that it has come in contact with moisture or water. We cannot buy this phone. Top Dollar is paid for quality phones. To obtain this, each cell phone must be in working condition. That means it should meet all the functions mention above. Each phone's physical condition must be aesthetically appealing. Finally, they should fully charged before send to us.
- All phones must power up and the cell phone must be able to make a 611 test call.
- When you ship your phone(s), make sure they are packed well so that upon arrival they will not be crushed or otherwise damaged from shipping. We do not accept liability associated with damaged merchandise sent to us.
- Please do not attempt to sell a phone that is stolen or one that has been found; it will be reported to proper authorities.
- PHONES WITH SIM CARDS DO NOT NEED TO BE RELEASED OR HAVE A ZERO BALANCE. All others MUST be released and have a zero account balance. Phones that have not been released and carry an unpaid balance may be returned, but at owners' expense (to include shipping and rejection fees).
- Each cell phone must have valid and verifiable IMEI or ESN Serial Number. That means we will not accept a phone that is missing the serial number sticker inside or is scratched off of blotted out.
- Phone(s) that arrive with non-working batteries will be accepted but a $10.00 battery replacement fee will be deducted from your phone(s) purchase price. Please make sure phone(s) are fully charged before sending.
- We will pay you for the phone(s) within 30 business days of receipt and processing. You will be paid by Company Check via US First Class Mail.
- IT IS YOUR RESPONSIBILITY TO REMOVE US FROM YOUR SPAM BLOCKER. ALL CORRESPONDANCE IS CONDUCTED VIA EMAILS.
CashMyPhone.com Responsibilities
- Once you submit a Purchase Request to sell your phone, we will process that order and send you a notification via email indicating that we have received your submission, reviewed it, and conditionally accepted it. It is conditional because we have not yet had an opportunity to view the product and test it.
- Once we receive your phone, we will send you an email indicating that your phone has arrived and is being "processed". Processing can take several weeks due to volume, so please be patient.
- Payment will be made after 30 business days of the receipt of cell phone(s).
- We will answer all emails submitted by members selling their phones. Please allow us a maximum of 24 hours to respond. (We are not open on Holidays and Weekends)
- No matter how many phones you submit, we treat each phone as though it has it's own contract. Therefore, if you send more than one phone and one of them is in less than acceptable condition, all the others will proceed as originally designated and the processing of the rejected phone(s) will stop. We will submit an email to you indicating the reason for it's rejection. You will be required to pay for return shipping and handling associated with the processing of your phone thus far, should you want it back. A handling fee is $10.00. Shipping is $4.00 for the first unit of cell phone and $2.50 for each additional unit. Return fee must paid within 10 business days. If return fee is not paid after 10 business days, CashMyPhone.com will dispose/recycle all disqualified handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). CashMyPhone.com is not liable for any disposed/recycled handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).
- CashMyPhone.com is not responsible for any lost or stolen packages during shipment.
- In the rare event that an exception is made, CashMyPhone.com can only guarantee that you will receive the same model, not the exact phone(s) that were sent in. If the unit was working, you will receive back a working unit. If the unit was defective you will receive back a non-working unit.
- All pricing is subject to change without notice. For all prices, products and offers, CashMyPhone.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances.
Introduction
Cashmyphone.com provides an online link for consumers to sell their unused wireless handset(s), unused game(s), unused Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s). The online quote generator provides a firm quote in real time for qualified users. We reserve the right to amend, cancel or alter these services at our sole discretion.
THE USE OF THIS SITE IS GOVERNED BY THE POLICIES, TERMS AND CONDITIONS SET FORTH BELOW IN THIS USER AGREEMENT ("AGREEMENT"). PLEASE READ THIS AGREEMENT CAREFULLY. YOUR REGISTRATION, YOUR USE OF THIS SITE AND YOUR PLACEMENT OF A TRANSACTION AND/OR AN ORDER INDICATES YOUR ACCEPTANCE OF THESE POLICIES, TERMS AND CONDITIONS.
WE MAY AMEND THIS AGREEMENT AT ANY TIME BY POSTING THE AMENDED TERMS ON OUR SITE. EXCEPT AS STATED BELOW, THE AMENDED TERMS WILL AUTOMATICALLY BE EFFECTIVE IMMEDIATELY AFTER THEY ARE POSTED.
Registration
Our services are available only to registered users who are 18 years old or older and can form legally binding contracts under applicable law. Our services are not available to minors. If you do not qualify, please do not attempt to use our services. Registration requires the completion of the user registration form with accurate and complete contact names, principal address, and e-mail address.
Your use of Cashmyphone.com may be terminated or suspended by us if you do not comply with this Agreement, our policies and procedures, or for any other reason we determine necessary, in our sole discretion, to protect us and other users of the site.
Trade Acceptance Policy
Your receipt of a transaction confirmation only signifies that Cashmyphone.com will pay full value if the handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) sent are in acceptable condition as outlined below.
The shipment of your handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) confirms your acceptance of our price and condition offer. Under no circumstances will handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) be returned unless our offer is different that originally agreed to.

Condition of Handset(s)
In order to qualify for payment all handset(s) must be in working condition. They will power-up and make a test call. They will not be physically damaged, reported lost/stolen, water damaged, have broken LCD's or have any malfunction parts. Cases should be complete and unbroken. All handset(s) shall have a valid ESN or IMEI.
Any handset(s) sent in other than those listed on the initial transaction will not be returned and will become the property of Cashmyphone.com. These units will be recycled or donated to non-profit organizations. Please verify the accuracy of your transaction before submitting for approval. If you wish to change your transaction simply contact Customer Service online.
Please include the battery. Accessories, such as chargers and manuals, are not necessary. Please dispose of these items properly.

Condition of Game(s)
In order to qualify for payment all game(s) must be in working condition. They will run smooth and playable. We do not purchase IMPORT games or accessories. All items and prices listed are for US/North American NTSC format merchandise. We do not purchase copied/pirated games. We reserve the right to refuse any purchase. We co-operate with local, state, and federal authorities and make all information submitted during the buyback process available to them upon request. All games shall have a valid UPC code corresponding to each game.

Condition of Apple iPod(s)
In order to qualify for payment all Apple iPod(s) must be in working condition. All Apple iPods sent in must be fully functional. Apple iPods must be owned by the individual participating in this transaction. Apple iPods that have had the external case opened by anyone except for Apple are not accepted. Apple iPods with cracked/broken cases, track wheels not working, cannot power on, dead battery or have a broken LCD are not accepted. All Apple iPods shall have a valid Serial Number.

Condition of Sony Playstation Portable (PSP) Console(s)
In order to qualify for payment all Sony Playstation Portable(PSP) Console(s) must be in working condition. All Sony Playstation Portable(PSP) Consoles sent in must be fully functional. Sony Playstation Portable(PSP) Consoles must be owned by the individual participating in this transaction. Sony Playstation Portable(PSP) Consoles that have had the external case opened by anyone except for Sony are not accepted. Sony Playstation Portable(PSP) Consoles with cracked/broken cases, joysticks or keypad not working, cannot power on, dead battery or have a broken LCD are not accepted. All Sony Playstation Portable(PSP) Console(s) shall have a valid Serial Number or UPC Number.

Cell Phone Services
It is the responsibility of the user to discontinue service on handsets sold to Cashmyphone.com before initiating a transaction. Cashmyphone.com is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.
Personal / User / Subscriber Information
If desired, it is the responsibility of the user to remove any and all personal information from all handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) memory and removable memory including but not limited to, phonebook entries, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. Any personal information including but not limited to the aforementioned data could be used in a negative manner and it is the sole responsibility of the user to clear all information that could be harmful to the user if made public.
Payment
Payment will be made after 30 days of the verification of received handset(s), game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s). If there is a dispute in condition users will be notified by e-mail with an adjusted trade offer. If the adjusted offer is not acceptable, Cashmyphone.com will return the shipment at the users¡¯ expense via a minimum $10 shipping and handling charge. If the adjusted offer is accepted the adjusted payment will be made based on the date of the original trade. Cashmyphone.com will not be responsible for user delays. User must respond to any adjusted trade offer within three business days or Cashmyphone.com will assume the adjusted offer is acceptable and process the shipment using the adjusted offer.
All checks will be issued in "care of" and must be endorsed by the consumer who placed the transaction. Inclusion of "Company Name" on transactions does not imply that checks will be issued in care of that company. Should a change need to be made, a $15 fee will be deducted from the adjusted check.
Federal Law states that any payout exceeding $600 in a calendar year, either cumulative or individual transaction(s), cannot be fulfilled until a valid W9 form is submitted. Should your total transaction(s) meet or exceed $600 in a given calendar year, Cashmyphone.com must have a valid signed W9 form on file in order to proceed with payment of any current, outstanding, or future transactions for the said year.
Pricing
All pricing is subject to change without notice. For all prices, products and offers, Cashmyphone.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances.
Expiration of Offer
All trade offers will expire 30 days from the date of trade confirmation. All confirmed trade pricing will be honored within the 30 day period regardless of current pricing.
Returns
All disqualified or not accepted handsets, game(s), Apple iPod player(s), and Sony Playstation Portable(PSP) Console(s) will return at users¡¯ expense via a minimum of $10 shipping and handling fees and notified via by e-mail. Return fee must paid within 10 business days. If return fee is not paid after 10 business days, Cashmyphone.com will dispose/recycle all disqualified handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). Cashmyphone.com is not liable for any disposed/recycled handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).

Disqualified Transaction
Cashmyphone.com will not be responsible for user delays. User must respond to the ¡°Disqualified¡± notification e-mail within 10 business days or Cashmyphone.com will dispose/recycle all disqualified handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s). Cashmyphone.com is not liable for any disposed/recycled handset(s), game(s), Apple iPod player(s), or Sony Playstation Portable(PSP) Console(s).

Independent Contractor
This Agreement and your membership in no way constitute or give rise to a partnership, joint venture or other relationship between the parties. Each of us will operate under the terms of this Agreement as an independent contractor and not as an agent for the other.
